Advocates for Prattsburgh has retained Derek Brockelbank of the Brockelbank Law Firm in Canandaigua to represent us in the fight against eminent domain in Prattsburgh. We need your help in waging this fight to defend all of our rights. For many years Derek Brockelbank was the lawyer for the City of Canandaigua and he is experienced in municipal law and eminent domain and is familiar with SEQR (State Environmental Quality Review). Mr. Brockelbank will be representing us in Bath on July 1 at 10:00AM when we attempt to have Harold McConnell's vote on eminent domain thrown out due to conflict of interest. The hearing is open to the public.

We will not have the judgment to the July 1 hearing immediately, which means we need to be prepared to appeal the condemnations. Once the town notifies the landowners of condemnation, the landowners will have 30 days to appeal. That means that our lawyer must prepare an appeal on behalf of the condemnees, while we wait for the outcome of the July 1 hearing. If McConnell's vote is thrown out, we will not need to proceed with the appeal, but we may not know that until the 30 days is over, and if his vote is not thrown out and we have not appealed, then there will be nothing we can do to stop the condemnations.

Fact: No. If you live or own property in the 35 square-mile Ecogen “Project Area” – where the great majority of the landowners have NOT leased to the windfarm developers – the industrial park has been brought to you, and you and your neighbors live inside it.
